The Civil Aviation Authority of the Philippines has issued a firm warning to the public regarding smoking onboard flights. Officials reported that passengers caught smoking or vaping during air travel will face strict penalties. This announcement follows several reports from airlines about incidents involving prohibited smoking and vaping inside aircraft cabins.
Legal Framework Backing the Ban
According to community members familiar with aviation regulations, smoking onboard flights is prohibited under the Philippine Civil Aviation Regulations. These rules align with Republic Act 9211, known as the Tobacco Regulation Act of 2003, and Republic Act 11900, the Vaporized Nicotine and Non-Nicotine Products Regulation Act. Both laws strictly ban smoking and vaping in public facilities, including airports and airplanes.
Penalties for Violators on Smoking Onboard Flights
Local leaders noted that those caught smoking onboard flights face escalating fines. The first offense under the Tobacco Regulation Act incurs a penalty ranging from P500 to P1,000. Subsequent offenses increase to fines between P1,000 and P5,000 for the second violation, and P5,000 to P10,000 for the third.
Meanwhile, vaping offenses carry even steeper fines. The Vaporized Nicotine and Non-Nicotine Products Regulation Act imposes a P5,000 fine for the first offense. Repeat violations lead to penalties of P10,000 and P20,000 for the second and third offenses, respectively.
