Criminal Complaint Filed Over Advertising Revenues Misappropriation

Complaint Filed Over Advertising Revenues Misappropriation

A criminal case for estafa with abuse of confidence has been filed against several senior executives of Television and Production Exponents, Inc. (TAPE). The complaint alleges the misappropriation of nearly ₱38 million in advertising revenues.

The lawsuit was submitted to the Office of the City Prosecutor in Quezon City. It names six TAPE officers as respondents, including former Presidents and CEOs, board members, and finance personnel. Among those accused are the former President and CEO, the Chairman of the Board, the Treasurer, the former COO who is now President and CEO, the former Senior Vice President for Finance, and a finance consultant.

Details of the Alleged Misappropriation

According to sources familiar with the matter, the case centers on the executives’ alleged failure to remit advertising funds collected from clients. These revenues were contractually assigned to a broadcasting network under a 2023 Assignment Agreement.

Despite repeated formal demands, the funds were reportedly not transferred because they were instead used to cover TAPE’s operational expenses. This action is said to violate the trust arrangement clearly outlined in the agreement.

Legal Action and Goals

The filing aims to hold the accused TAPE officers accountable for their actions. It also seeks to recover the full amount of ₱37,941,352.56, which represents the advertising revenues that were allegedly misused.

Officials pursuing the case emphasize the importance of ensuring transparency and responsibility in handling client funds. They aim to prevent similar incidents from happening in the future by setting a precedent through this legal action.

Impact on Industry and Stakeholders

This complaint highlights growing concerns about financial management in media production companies. Experts say that safeguarding advertising revenues is crucial for maintaining trust between production firms and their broadcasting partners.

Community leaders and media analysts note that accountability measures like this can strengthen industry standards. By addressing such cases promptly, companies demonstrate their commitment to ethical business practices and client trust.
