DILG Calls for Local Action on Vaporized and Non-Nicotine Products
The Department of the Interior and Local Government (DILG) has urged all local government units (LGUs) to enforce the ban on vaporized and non-nicotine products inside indoor public spaces. This directive, emphasized on June 2, requires LGUs to uphold restrictions on using these products in places like elevators, stairwells, and similar enclosed areas.
The call to action aligns with President Ferdinand ‘Bongbong’ Marcos Jr.’s directives aimed at regulating smoking and vaping. “Pass ordinances that support the enforcement of national laws regulating tobacco, vapor, and vaporized nicotine products,” the DILG stated, urging local authorities to strengthen their tobacco control efforts.
Aligning Local Ordinances with National Laws
According to sources, the DILG highlighted the importance of local legislation that complements existing national laws, prohibiting LGUs from setting their own standards on the sale, manufacture, or distribution of tobacco and vapor products. The department reminded LGUs to actively implement Republic Act (RA) 9211 (Tobacco Regulation Act of 2003), RA 11900 (Vaporized Nicotine and Non-Nicotine Products Regulation Act), RA 10643 (Graphic Health Warning Law), and related laws including RA 11467 and RA 10351.
Furthermore, the department encourages LGUs to establish smoke-free environments by designating specific smoking areas and mandating the display of graphic health warnings to inform the public about the risks associated with tobacco and vapor product use.
Coordination with Bureau of Internal Revenue
The DILG also emphasized the need for LGUs to work closely with the Bureau of Internal Revenue (BIR) to enforce the minimum floor prices for vapor products and nicotine salts sold in local markets. This measure aims to curb illegal sales and ensure compliance with pricing policies.
