DOLE Announces Pay Rules for August Holidays

The Department of Labor and Employment (DOLE) has unveiled clear pay rules for two significant holidays in August. These guidelines aim to ensure workers receive appropriate compensation during these special observances.

In line with Proclamation No. 727, signed by President Ferdinand Marcos Jr. on October 30, 2024, August 21 is designated as Ninoy Aquino Day, a special non-working holiday marking the 42nd anniversary of the senator’s assassination. Meanwhile, August 25 is recognized as National Heroes Day, a regular holiday honoring the courage and sacrifice of Filipino heroes who fought for the nation’s freedom.

Pay Rules for August 21 Special Non-Working Holiday

For Ninoy Aquino Day, classified as a special non-working holiday, DOLE specifies the following pay regulations:

  • If an employee does not work on this day, the “no work, no pay” policy applies unless a collective bargaining agreement states otherwise.
  • Employees who work on August 21 must receive an additional 30% of their basic wage for the first eight hours (basic wage x 130%).
  • For overtime beyond eight hours, the pay rate increases by an additional 30% on the hourly rate (hourly rate x 130% x 130% x hours worked).
  • If the special non-working holiday falls on an employee’s rest day and they work, the employer must pay 150% of the basic wage for the first eight hours (basic wage x 150%).
  • For overtime on such a rest day, an extra 30% of the hourly rate applies (hourly rate x 150% x 130% x hours worked).

Pay Rules for August 25 Regular Holiday

National Heroes Day on August 25 is a regular holiday, and the pay rules differ accordingly:

  • Employees who report to work or are on paid leave the day before the holiday receive 100% of their daily wage.
  • Work performed on the regular holiday is compensated at double pay for the first eight hours (basic wage x 200%).
  • Overtime beyond eight hours earns an additional 30% on the hourly rate (hourly rate x 200% x 130% x hours worked).
  • If the holiday coincides with an employee’s rest day and they work, the pay is 130% of the double rate (basic wage x 200% x 130%).
  • For overtime work on a rest day during the holiday, the employee receives an extra 30% on the hourly rate (hourly rate x 200% x 130% x 130% x hours worked).

Ensuring Fair Compensation on Special Days

Officials reported that these pay rules aim to protect workers’ rights and ensure fair compensation during significant holidays. Community members noted the importance of understanding these guidelines to avoid disputes and ensure compliance.

Local leaders emphasized that employers must adhere strictly to these regulations to uphold labor standards and recognize the value of employees’ work during special and regular holidays.
