Lawmakers Urge Charter Change Proposals Early in Congress

MANILA, Philippines — As the current administration enters its latter half, some lawmakers insist there is still ample time to pursue charter change proposals early, focusing on revising the 1987 Constitution’s economic and territorial provisions. Representatives Alfredo Garbin of Ako Bicol and Bienvenido Abante Jr. of Manila’s 6th District expressed confidence that the 20th Congress can deliberate these proposed changes. They pointed out that similar resolutions have previously passed the House, indicating a favorable path forward despite ongoing political challenges.

Garbin Files Resolution to Amend Key Constitutional Articles

On Tuesday, Garbin submitted Resolution of Both Houses (RBH) No. 1, which aims to amend Articles I (National Territory), XII (National Economy and Patrimony), XIV (Education, Science, Technology, Arts, Culture and Sports), and XVI (General Provisions) of the Constitution.

He reminded reporters that “for the past two Congresses, we have passed this and transmitted it to the Senate.” He emphasized, “It is always the time to do the right thing. There is no other time to do the right thing. The time is always right if you’re doing the right thing.” This statement underscores his firm belief in acting without delay.

Support and Timing Considerations for Charter Change Proposals Early

Abante voiced strong support for the measure and expressed willingness to become a principal author. He recalled, “I’ve always supported charter change, ever since I was a councilor of Manila in 1992, it was still President (Fidel) Ramos at the helm, and he was promoting charter change which I supported. We really need to have charter change.” He stressed the need to “start charter change now” without postponement.

Despite the Senate’s anticipated impeachment trial of Vice President Sara Duterte, Abante believes discussions can proceed during the first regular session. “I think if charter change would happen in the first year of Congress, there may be time,” he noted. However, he cautioned that delays or mid-term efforts might limit available time for thorough debate.

Constitutional Amendments to Reflect Sovereignty and Economic Reforms

Garbin’s proposal notably includes amending Article I to align with the United Nations Convention on the Law of the Sea (UNCLOS) and to incorporate the 2016 Permanent Court of Arbitration (PCA) ruling. This ruling affirms the Philippines’ exclusive rights over its waters, countering China’s nine-dash line claim. He remarked, “Our president said we will not give not even an inch of our territory […] – my contribution in upholding the arbitral case that we won and the Unclos.” This reinforces the national commitment to sovereignty.

Last March, the 19th Congress approved a similar resolution easing restrictive economic provisions, allowing Congress to set foreign ownership limits in sectors like public utilities, education, and advertising. Garbin’s current RBH No. 1 expands these amendments to include more industries, aiming for broader economic liberalization.

Senate Counterpart and Next Steps

A corresponding Senate measure, RBH No. 6, was filed but remains unaddressed following the 19th Congress session’s conclusion. Despite this, proponents remain optimistic about advancing charter change proposals early in the 20th Congress.
