Military Court Rules on Philippine Army Officers

A military court has delivered its verdict on a case involving a Philippine Army general and three soldiers accused of violating the Articles of War. The case centers on the 2022 killing of a businesswoman and model based in Davao City. The ruling highlights the army’s commitment to upholding discipline and justice within its ranks.

Brigadier General Jesus Durante III, the former commander of the Army’s 1001st Infantry Brigade, along with Sergeant Delfin Sialsa, Corporal Adrian Cachero, and Private First Class Rolly Cabal, were found guilty of violating Article of War 97. This article addresses conduct prejudicial to good order and military discipline. According to reports, Durante received a formal reprimand, while Sialsa and Cachero were sentenced to prison terms ranging from 10 to 12 years. Cabal was given a prison term of four to six years. The three soldiers were also dishonorably discharged.

Acquittals and Cleared Charges in the Case

Meanwhile, Durante and his former deputy, Colonel Michael Licyayo, were acquitted of violating Article of War 96, which concerns conduct unbecoming an officer and a gentleman, due to insufficient evidence. Two other former subordinates, Master Sergeant Ariel Ballesteros and Staff Sergeant Gilbert Plaza, were also cleared of charges under Article of War 97.

The Philippine Army has not provided further details about the court’s ruling. However, sources familiar with the matter confirm that the military justice system has taken these cases seriously and proceeded with thorough investigations.

Background of the Incident and Allegations

The case stems from the murder of Yvonette Chua Plaza, who was shot by motorcycle-riding assailants outside her home in Davao City in December 2022. Investigators from the Philippine National Police suggested a possible motive related to jealousy, citing an alleged intimate relationship between Durante and Plaza. However, Durante has denied these claims, stating that their relationship was purely friendly.

Army’s Commitment to Justice and Discipline

The Philippine Army has assured the public and Ms. Plaza’s family that justice was pursued with diligence and integrity throughout the process. A spokesperson said, “The Philippine Army assures the public and the family of Ms. Yvonette Chua Plaza that justice has been pursued with full diligence and integrity.”

This case underscores the military’s efforts to maintain discipline and uphold the rule of law, even among its highest-ranking officers.
