Prosecution Seeks Extension on Witness Disclosure Deadline
The Office of the Prosecutor at the International Criminal Court (ICC) has formally requested an extension for the deadline to submit key evidence materials and disclose the identities of witnesses in the crimes against humanity case against former President Rodrigo Duterte. This request highlights concerns for witness safety and aims to promote judicial efficiency.
In a detailed seven-page document dated May 14, signed by a senior prosecutor, the prosecution asked the Pre-Trial Chamber I (PTC I) to push the deadline for disclosing evidence and witness identities to July 1, aligning it with the general disclosure deadline. Additionally, they sought to extend the final date for applications to withhold witness identities from May 23 to June 20.
Ensuring Witness Safety and Judicial Economy
The prosecution explained that immediate disclosure of witnesses’ identities could pose serious risks to their safety. They are working closely with their Security and Protection Unit to put in place adequate protective measures. Once these are established, they aim to disclose witness information no later than July 1, 2025.
For the sake of witness security and to streamline court proceedings, the prosecution believes that extending the deadline for all non-disclosure applications to June 20 will allow the Chamber to review all cases together. This approach would help fully appreciate the potential impact of withholding witness identities.
The prosecution emphasized that these extension requests respect both the rights of the accused under the ICC’s Rome Statute and the protections guaranteed to witnesses. They also noted that the proposed extensions are consistent with timelines observed in recent ICC cases, ensuring fairness and transparency.
Ongoing Investigations and Upcoming Proceedings
Despite seeking these extensions, the prosecution reassured that it continues to carry out investigations without disrupting the disclosure process or the confirmation of charges. They plan to share new evidence promptly and on a rolling basis rather than waiting for deadlines.
Former President Duterte is scheduled to appear before the Pre-Trial Chamber I on September 23 for the confirmation of charges hearing. Aside from the extension requests, the Chamber will also consider the defense team’s challenge to the court’s jurisdiction.
The former leader faces charges related to crimes against humanity linked to his controversial war on drugs, which resulted in thousands of deaths, predominantly among poor Filipinos. Duterte is currently detained in The Hague, Netherlands.
