Prosecutors’ Motion Withdrawn Following Calls to Investigate Abusive Prosecutors
The head of the National Prosecution Service (NPS) responded cautiously to the call from Mamamayang Liberal Party-List Representative Leila de Lima to investigate abusive prosecutors. Taking things one step at a time, the NPS has acted on recent developments in de Lima’s drug case while addressing concerns about prosecutorial conduct.
De Lima remains at the center of a legal battle involving a drug case where the prosecutorial panel initially sought to reconsider her acquittal. However, Justice Secretary Jesus Crispin Remulla intervened, speaking with Prosecutor General Richard Anthony Fadullon, and instructions were issued to immediately withdraw the motion for reconsideration.
Withdrawal of Motion for Reconsideration
De Lima expressed gratitude for the Department of Justice’s formal withdrawal of the motion but continues to press for an investigation into abusive prosecutors. Prosecutor General Fadullon emphasized, “Let’s take things one step at a time,” signaling a measured approach to the issue.
Earlier this year, the Court of Appeals reversed the acquittal of de Lima in one of her drug-related cases. The appellate court cited grave abuse of discretion by the Muntinlupa Court, pointing to a failure to explain specific facts and the legal basis for the acquittal.
The case was then sent back to the lower court, which reaffirmed its decision to acquit de Lima. Following this, the panel of prosecutors filed a motion for reconsideration but withdrew it shortly after, signaling a pause in their legal pursuit.
Calls to Investigate Abusive Prosecutors
De Lima’s call to investigate abusive prosecutors highlights ongoing concerns regarding fairness and integrity within the justice system. Many observers note that addressing such issues is critical to restoring public trust and ensuring accountability.
The NPS’s cautious response suggests a stepwise process in handling both the legal case and the broader issues raised. Meanwhile, stakeholders await further developments as the legal proceedings continue.
