Sandiganbayan Acquits Binays in Makati Carpark Case
Former Vice President Jejomar Binay and his son, former Makati Mayor Junjun Binay, were acquitted by the Sandiganbayan in connection with graft and corruption allegations linked to the P2.2-billion Makati car park building project. Officials reported that the anti-graft court found insufficient evidence to convict them, stating that the prosecution failed to prove guilt beyond reasonable doubt.
The Binays, together with 22 other co-accused, faced charges including graft, falsification of public documents, and malversation of public funds. The charges stemmed from various phases of the car park construction, which has been under scrutiny for years.
Background of the Charges
The elder Binay was charged for alleged irregularities during the first three phases of the car park’s construction while serving as Makati mayor. Conversely, his son was accused of misconduct related to phases IV and V of the project after assuming office.
Sources noted that the younger Binay’s charges involved the release of large payments to Hilmarc’s Construction without proper documentation or approved plans. For phase IV, he allegedly authorized P649.2 million despite baseless accomplishment reports and missing performance security from the contractor.
Likewise, for phase V, Junjun Binay reportedly approved a P141.6 million payment under similar questionable circumstances, according to community members familiar with the case.
Falsification Allegations and Administrative Sanctions
In addition to graft, Junjun Binay faced accusations of falsifying public documents. Officials reported that he was implicated in altering a July 7, 2011, issue of the Balita newspaper and its affidavit of publication to fabricate evidence of a public bidding invitation.
Despite these allegations, the Sandiganbayan dismissed the charges due to lack of conclusive proof. However, local leaders highlighted that the Ombudsman had previously ordered Binay Jr.’s dismissal and permanent disqualification from public office over administrative offenses related to the project.
Case Implications and Public Reaction
The court’s decision marks a significant development in a long-standing controversy involving prominent political figures. Community members expressed mixed reactions, with some welcoming the acquittal while others called for continued vigilance against corruption.
Legal experts commented that this case underscores the challenges in prosecuting high-profile graft cases in the country, especially when evidence is inconclusive or procedural lapses occur.
