Sandiganbayan Denies Motion in 1998 Well-Drilling Case
MANILA, Philippines — The Sandiganbayan has dismissed the motion for reconsideration filed by former Davao City Water District (DCWD) General Manager Wilfredo Carbonquillo concerning the 1998 well-drilling project. The court described the motion as another attempt to delay proceedings in the case involving alleged irregularities.
Carbonquillo faces two graft charges for violating Section 3(e) of Republic Act No. 3019, also known as the Anti-Graft and Corrupt Practices Act. The accusations stem from supposed anomalies in the bidding and awarding process of a water supply system project nearly 30 years ago.
Anti-Graft Court Upholds Earlier Ruling
In a resolution dated August 1, the Sandiganbayan’s Third Division rejected Carbonquillo’s motion for reconsideration, which he filed on July 7, citing a lack of merit. The court emphasized that his arguments had already been thoroughly addressed in its previous resolution issued on July 4, 2025.
“We cannot allow this court to be made a party to such a dilatory tactic. We underscore that delays in the administration of justice not only impinge upon the accused but also the People, as represented by the prosecution, most especially in this case where public funds are involved,” the court added.
Carbonquillo’s Defense and Court’s Response
Carbonquillo argued that his 24-year absence as a fugitive had already infringed on his right to a speedy trial. He also claimed that his prolonged absence should not factor into the assessment of undue delay in his case.
However, the court responded that Carbonquillo should have filed a motion to quash the charges immediately instead of evading justice for over two decades. His extended flight effectively stalled the case and delayed justice.
“There is no other conclusion than the fact that Carbonquillo’s prolonged absence amounted to a waiver of his constitutional right to a speedy disposition of his case,” the court stated firmly.
Next Steps in the Case
Following this resolution, the Sandiganbayan set Carbonquillo’s arraignment for August 8. This marks a significant step forward in resolving the long-pending case involving alleged misuse of public funds nearly three decades ago.
