Senator-Judges Must Master Impeachment Proceedings

Senator-judges with no prior experience in impeachment proceedings should take it upon themselves to undergo training, especially as Vice President Sara Duterte’s impeachment trial approaches. This call to action emphasizes the need for all involved to fully understand the process before participating.

A spokesperson for the House prosecution panel, a seasoned lawyer, agreed with this suggestion during a press conference. “Nasa kanila yan eh, the initiative. So tama kayo,” he said, addressing the reporter who recommended seminars for first-time senator-judges.

He stressed that this move is particularly important for senators who are not lawyers. “Dapat po ay pag-aralan din nila itong proseso para magabayan sila sa kanilang gagawing hakbang. They should take the initiative to study the rules of impeachment. Lalo na po yung mga hindi abogado,” he added.

Failing to prepare, he warned, would leave senator-judges “walking in the dark.” “Hindi nila alam kung saan sila pupunta,” he said, highlighting the risks of entering such a critical trial without proper knowledge.

Concerns Over Senator-Judges’ Actions in Trial

During the same briefing, the prosecution’s representative criticized certain actions by the senator-judges, particularly pointing to Senator Ronald Bato dela Rosa. The senator moved to dismiss the impeachment complaint against Vice President Duterte, a move the spokesperson said should come from the defense, not from an impartial senator-judge.

The spokesperson also expressed concern over the Senate’s decision to send the articles of impeachment back to the House of Representatives. “The Constitution doesn’t contain the word remand when it comes to impeachment,” he pointed out, underscoring strict adherence to constitutional procedures.
