The National Police Commission (Napolcom) has mandated that summary dismissal proceedings for erring cops must conclude within 60 working days from the complaint filing. This clear timeline aims to ensure the fast disposition of cases and uphold accountability in the police service. Lawyer Rafael Vicente R. Calinisan, Napolcom vice chairperson and executive officer, emphasized the importance of this deadline in promoting efficiency and justice.

“This is justice with urgency. By setting clear timelines and holding everyone accountable to them, we ensure that complaints against police officers are resolved promptly – without delay, without injustice,” Calinisan said. “Our goal is simple but bold: no case shall drag on. We act fast, fair, and fearlessly.”

Strict timeline for complaint handling detailed

The commission’s order outlines specific deadlines to speed up the process. The initial evaluation of complaints must be done within one working day. Then, the pre-charge investigation should begin within two working days. Respondents have five working days to file counter-affidavits. Afterward, the investigation must end within three working days.

If grounds exist, the investigation report and draft formal charge must be submitted within five working days. Once probable cause is established, the formal charge must be issued within one working day. A hearing officer should then be assigned within one working day.

Fast-tracked hearings to ensure swift justice

Summons must be served within two working days, and the respondent is required to file an answer within seven working days. A pre-hearing conference must be held within three working days after receiving the answer. Position papers are to be filed within seven working days, with a clarificatory hearing held within two working days if necessary.

The hearing officer must submit the investigation report within seven working days. The Napolcom En Banc then has 14 working days to issue a final decision. This structured schedule aims to prevent delays and ensure justice is served promptly.

Reforms aim to restore trust and morale

Calinisan explained that this reform not only expedites disciplinary processes but also helps restore public trust and boost morale within the police force. Swift and fair resolutions to administrative complaints are crucial in maintaining integrity and discipline.

The order takes effect immediately and will stay in force until Napolcom updates Memorandum Circular No. 2016-002. This circular governs the administrative disciplinary rules and procedures for all Philippine National Police personnel.
