Authority and Protocol in PNP Leadership Changes
Senator Panfilo Lacson, who served as PNP chief from 1999 to 2001, explained that the designation and relief of key members of the PNP command group, such as the Deputy for Administration, Deputy for Operations, and Chief of Directorial Staff, require clearance from higher authorities. Typically, these changes must be approved by the President or at least the ex-officio Chairman of the National Police Commission, along with the Secretary of the Interior and Local Government.
“Torre acted beyond his authority of unilaterally relieving his second-in-command, Nartatez,” Lacson stated. He added that even when former President Joseph Estrada gave him broad authority to manage the PNP during his tenure, he refrained from exercising absolute control over command group appointments.
Presidential Prerogative and Smooth Transition
Despite the controversy surrounding the relief of General Nicolas Torre III, community members noted that the decision ultimately rests with President Ferdinand R. Marcos Jr. The President holds the sole prerogative to appoint or remove the PNP chief.
Senator Lacson emphasized the importance of a smooth transition to avoid disruptions in the police force’s mission. “What is important at this point is a smooth transition and transfer of command and authority so as not to hamper the overall mission of the PNP to continue maintaining peace and order for the benefit of the people whom they have sworn to serve and protect,” he said.
Changes in PNP Command Positions
In August, Lieutenant General Jose Melencio Nartatez Jr., who held the PNP’s second-highest post, was reassigned to lead the Area Police Command Western Mindanao. He was replaced by Commander Lieutenant General Bernard Banac, according to officials familiar with the reorganization.
